General Terms and Conditions for Contracts with Consumers
(or for business-to-consumer / B2C)

§ 1 Scope of Application

(1) These terms and conditions apply to all orders placed via the online shop of

Spirits Liberation Front - Mack Spirits GmbH, Neue Straße 45, 73277 Owen/Teck
Geschäftsführer/CEO Bernd Hausner und John Benjamin Savary (Anschrift wie vor)

Register Number: HRB 763105
Register Court: Stuttgart

- hereinafter: Seller -

and in which a consumer as defined by § 13 BGB is involved on the buyer’s side. A consumer (hereinafter also referred to as “Buyer”, “costumer” or “you”) in the sense of § 13 BGB is any natural person who enters into a legal transaction for a purpose that can neither be attributed to their commercial nor to their self-employed work.

§ 2 Contract Conclusion

(1) The product presentations in the Seller’s online shop serve only as an invitation to submit a purchase offer and do not constitute legally binding offers by the Seller. The customer can submit the offer via the online order form integrated in the Seller’s online shop. When placing an order via the online order form, the customer submits a legally binding contract offer for the goods contained in the shopping basket after entering their personal data and clicking the “Order” button in the final step of the ordering process.

(2) The Seller can accept the offer of the customer with an electronically transmitted order confirmation (by fax or e-mail) or by delivery of the goods within five days. The confirmation of the receipt of the order takes place via automated email immediately after sending the order and does not yet constitute acceptance of the contract.

(3) Should the order confirmation of the Seller contain spelling or printing errors or should the price determination be based on technical errors, the Seller is entitled to withdraw from the contract, whereby the Seller must prove the error. In this case, payments already made will be reimbursed immediately.

(4) Orders are generally processed and contact is made by e-mail and automatic order processing. The customer must ensure that the e-mail address provided by him for order processing is correct, so that the e-mails sent by the Seller can be received at this address. In particular, when using spam filters, the customer must ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller to process the order can be delivered.

§ 3 Protection of Minors

According to legislation for the protection of minors, contracts, in particular contracts for the purchase of alcoholic beverages, are only concluded with persons of full legal capacity, i.e. with persons who have reached the age of 18 respectively have reached the legal drinking age in their resident country. By placing an order with the Seller, the customer confirms that he or she is 18 years of age and of legal drinking age in their resident country. The customer is obliged to ensure that only they themselves or persons of full age authorized by them to accept the delivery accept the delivery of goods. The deliverer is entitled to demand proof of age upon delivery.

§ 4 Prices

(1) The prices stated on the Seller’s website at the time of the order shall apply to the conclusion of the purchase contract. These may be faulty in individual cases despite the best efforts of the Seller. However, the Seller will inform the buyer of this immediately when the order is placed. The buyer then has the possibility to decide whether they want to place their order.

(2) For each order a minimum purchase of 15,- € is applicable.

(3) The prices stated are gross sales prices stated in euros. They include the current value added tax in Germany of 19 percent or 7 percent of the net value of the goods as well as the excise tax for Germany and do not include shipping costs. If a deposit is charged on drink bottles, this is not yet included in the indicated price. Whether and how much deposit is due is specified in detail in the offers (in close proximity to the price of the goods).

(4) For orders from non-EU countries, the German value added tax included is deducted from the gross sales prices. If applicable, however, the buyer must pay the respective country-specific import sales tax at customs and pay import duties.

§ 5 Shipping Costs

(1) For deliveries within Germany the buyer can choose between different shipping options. These are calculated according to the shipping weight and the delivery time and can be viewed under the following link: Shipping overview

(2) For deliveries within the EU and for deliveries outside the EU there is at least one shipping option available, which can also be viewed under the link Shipping overview. For deliveries to non-EU countries, additional duties and charges apply. Further information can be found at https://ec.europa.eu/taxation_customs/home_en and on import sales tax at
http://auskunft.ezt-online.de/ezto/Welcome.do and specifically for Switzerland at http://xtares.admin.ch/tares/login/loginFormFiller.do.

§ 6 Terms of Delivery

(1) The delivery time within Germany is 3-5 days from order or receipt of payment, unless otherwise stated in the offer. The delivery time for other EU countries can be up to 14 days. Deliveries to non-EU countries can take up to 6 weeks depending on the destination—in this case, the duration depends on the selected mode of dispatch and on the processing time of the respective customs office at the destination country.

(2) If not all ordered products are in stock, the Seller is entitled to make partial deliveries at his own expense, insofar as this is reasonable for the buyer.

(3) The delivery of goods takes place routinely through dispatch and to the delivery address indicated by the customer. The delivery address specified in the Seller’s order is decisive for the processing of the transaction. If delivery to the customer is not possible, the commissioned transport company sends the goods back to the Seller, whereby the customer has to bear the costs for the unsuccessful delivery. In this case the Seller can withdraw from the contract. In this case, any payments made for the goods (excl. delivery costs) will be reimbursed immediately.

(4) If the ordered product is not available because the Seller has not been supplied with this product by his suppliers through no fault of his own, the Seller can withdraw from the contract. In this case, the Seller will immediately inform the buyer and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or if the buyer does not wish delivery of a comparable product, the Seller will immediately reimburse the buyer for any payment already made.

§ 7 Terms of Payment

(1) For deliveries within Germany, the Seller offers the following payment options, unless otherwise specified in the respective product description in the offer:
Prepayment by bank transfer
Paypal, credit card (from a minimum order value of 15,- Euro)
If prepayment has been agreed upon, payment is due immediately after conclusion of the contract. The bank details can be found in the terms of payment.

If the payment method PayPal is selected, the customer’s PayPal account will be debited upon completion of the order.

If the payment method “Sofortüberweisung” is selected, the customer’s bank account will be debited when the order is completed.
When paying by PayPal or “Sofortüberweisung” the customer hereby gives his express consent to debit the credit card or bank account immediately after receipt of the order.

(2) If shipping abroad is also offered for the respective product, the above payment options are also available to the customer for deliveries abroad, unless otherwise specified in the respective product description in the offer and provided that the payment service provider is available in the customer’s country.
For deliveries to countries outside the European Union, additional costs may be incurred in individual cases, such as additional taxes and/or duties, for example in the form of customs duties.

(3) The customer is only entitled to a right to compensation if his counterclaims have been legally established in court, or are undisputed, or have been acknowledged in writing by the Seller.

(4) The buyer can only exercise the right to lien if the claims result from the same contractual relationship.

§ 8 Retention of Title

The goods remain the property of the Seller until full payment has been received. Prior to the transfer of ownership, use as collateral, transfer by way of security, processing or transformation is not permitted without our consent.

§ 9 Right of Revocation for Consumers in Accordance with § 13 BGB (German Civil Code)

(1) Consumers have a fortnightly right of revocation. A consumer as defined by § 13 BGB is any natural person who enters into a legal transaction for a purpose that can neither be attributed to their commercial nor to their self-employed work.

(2) There is no right of revocation for commercial customers (B2B) and companies (see also GTC for contracts with commercial customers and business partners).

Right of Revocation:

You have the right to revoke the contract within fourteen days without giving any reasons. The period of revocation is fourteen days from the date on which you or a third party appointed by you, who is not the dispatcher, has taken possession of the goods. To exercise your right of revocation, you must inform the Seller of your decision to cancel the contract by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) to Spirits Liberation Front - Mack Spirits GmbH, Neue Straße 45, 73277 Owen/Teck, Germany, customer@slf.store.
You can use the revocation form or another clear declaration and send it to us by letter, fax or electronically. If you make use of this option, the Seller will immediately (e.g. by e-mail) send you a confirmation of receipt of the revocation. In order to comply with the revocation period, it is sufficient that you send the notice of the exercise of the revocation before the expiry of the revocation period.

Consequences of Revocation:

If you cancel the contract, the Seller shall reimburse you without delay and no later than fourteen days from the date on which the Seller receives notice of your cancellation of this contract, including the delivery costs (with the exception of the additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us). For this refund, the Seller will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. The Seller may refuse to return the goods until Seller has received them back or until you can prove that you have returned the goods, whichever is earlier. You must return the goods immediately and in any case within fourteen days at the latest from the date on which you inform the Seller of the revocation of this contract to
Spirits Liberation Front - Mack Spirits GmbH, Neue Straße 45, 73277 Owen/Teck, customer@slf.store
to be sent back or handed over. The deadline is met if you dispatch the goods before the expiry of the fourteen-day deadline.
You bear the direct cost of returning the goods. The cost of particularly large products is estimated at a maximum of EUR 40. You shall only be liable for any loss in value of the goods if such loss in value is due to handling of the goods that is not necessary for assessing the nature, properties and functionality of the goods.
End of revocation information

Special Notes:

(1) According to § 312g paragraph 2 sentence 1 No. 1 BGB, the right of revocation does not apply to contracts for the delivery of goods which are manufactured according to customer specifications or which are clearly tailored to the personal needs of the customer.

(2) Please avoid damage and contamination. If possible, return the goods to the Seller in their original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to provide sufficient protection against damage in transit in order to avoid claims for damages due to damage due to defective packaging.

(3) Please return the goods as a stamped package to the Seller and keep the receipt of posting. The Seller will also be happy to reimburse you the postage costs in advance if you do not have to bear them yourself.

(4) Please note that the modalities mentioned in paragraphs 2 and 3 are not a prerequisite for the effective exercise of the right of withdrawal.

§ 10 Damage in Transit

If goods are delivered with obvious transport damage, please complain about such errors immediately to the deliverer and contact the Seller as soon as possible by phone +49 30 616 754 109. Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help to assert the Seller’s own claims against the carrier or transport insurance.

§ 11 Warranty

Warranty is provided in accordance with the statutory provisions.

§ 12 Copyright and Trademark Rights

(1) The contents of this website, in particular the illustrations, drawings, photographs and texts are protected by copyright. They may only be used by customers to record our range of goods and for the purpose of concluding and executing a contract with the Seller. Furthermore, customers are not entitled to use the contents of this website. In particular, customers are prohibited from copying, distributing, exhibiting or publicly reproducing the contents. Violations of the copyright protection to which the Seller is entitled entitle the Seller to assert claims for injunctive relief and, if applicable, claims for damages.

(2) The name “Spirits Liberation Front,” “SLF” and the logo are registered trademarks and are also protected by a company trademark. Violations of these rights to which the Seller is exclusively entitled may result in the assertion of claims for injunctive relief or damages by the Seller.

§ 13 Applicable Law

(1) The laws of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws governing the international sale of movable goods. In the case of consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.

(2) The EU Commission offers the possibility of online dispute resolution on an online platform it operates at http://ec.europa.eu/consumers/odr/

(3) Spirits Liberation Front - Mack Spirits GmbH is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final Clauses

Should these General Terms and Conditions not have become part of the contract, in whole or in part,or should they be invalid, the remainder of the contract shall remain effective. (1) The product presentations in the Seller’s online shop serve only as an invitation to submit a purchase offer and do not constitute legally binding offers by the Seller. The customer can submit the offer via the online order form integrated in the Seller’s online shop. When placing an order via the online order form, the customer submits a legally binding contract offer for the goods contained in the shopping basket after entering his personal data and clicking the "Order" button in the final step of the order process.

(2) The Seller can accept the offer of the customer by an electronically transmitted order confirmation (fax or e-mail) or by delivery of the goods within five days.
